Washington, D.C. – In response to the House passing H.R. 4768, the Separation of Powers Restoration Act of 2016, Sara Chieffo, LCV Vice President of Government Affairs, issued the following statement:
“This radical legislation is a brazen attempt to advantage polluting companies who are trying to use legal challenges to dismantle core environmental and public health protections. This legislation allows unelected, non-expert judges to potentially throw out the work of the scientists, economists, lawyers, doctors, and other experts at the federal agencies who in many instances have also undertaken extensive comments from the public and impacted stakeholders. This over-reaching legislation nullifies the well-established judicial doctrine that for decades has meant courts give deference to the reasonable interpretations of expert federal agencies to carry out and enforce the laws that Congress enacts. We thank those who voted against this harmful bill and commend President Obama’s administration for already issuing a veto threat on this extreme and harmful legislation.”
