Re:  Oppose the judicial nomination of Judge Allison Eid to the United States Court of Appeals for the Tenth Circuit.

Dear Senator,

The League of Conservation Voters (LCV) works to turn environmental values into national, state and local priorities. Each year, LCV publishes the National Environmental Scorecard, which details the voting records of members of Congress on environmental legislation. The Scorecard is distributed to LCV members, concerned voters nationwide, and the media.

We urge you to oppose the judicial nomination of Judge Allison Eid to the U.S. Court of Appeals for the Tenth Circuit. Eid’s track record speaks for itself when it comes to our environmental and public health laws. She has written academic pieces that applaud the outcome of the Solid Waste Agency of Northern Cook County v. US Army Corps of Engineers decision, which limited the federal government’s role in enacting environmental legislation. In Colorado Oil & Gas Conservation Commission v. Grand Valley Citizens’ Alliance, Eid sided with oil companies, allowing them to bypass public hearings and local input before obtaining drilling permits.

Based on her record, if Eid is confirmed to serve a lifetime appointment on the federal bench, it could prove disastrous for environmental laws and regulations.

Equally concerning are Eid’s extreme views on fair elections and corporate interests. In Hall v. Moreno, her dissent supported the preservation of district lines, regardless of their impact on fair representation. If confirmed, Eid’s judicial opinions would embolden partisan election district mapping and threaten our core democratic values of a fair and equitable electoral process.

For these reasons, LCV strongly urges you to oppose the judicial nomination of Judge Allison Eid to the U.S. Court of Appeals for the Tenth Circuit. We will consider including this confirmation vote in the 2017 Scorecard.
