Representative Jay Obernolte (R-CA) sponsored H.J.Res. 89, an illegitimate Congressional Review Act (CRA) resolution of disapproval which seeks to repeal the Environmental Protection Agency’s (EPA’s) state preemption waiver for California’s Heavy-Duty Vehicle Omnibus rule. The CRA is an extreme and blunt tool that is being used by anti-environmental members of Congress who want to permanently strip away protections for our environment, communities, wildlife, and natural heritage. That said, both the non-partisan Government Accountability Office and Senate Parliamentarian ruled that the CRA cannot be used to revoke this waiver, because it is an agency order specifically issued for one state, and is not a rule, nor is it broadly applicable. Eliminating this waiver issued under the Clean Air Act would block California and other states from implementing these standards for cleaner trucks and buses that safeguard clean air, protect public health, and reduce greenhouse gas emissions. On April 30, the House approved H.J.Res. 89 by a vote of 225-196 (House roll call vote 112). NO IS THE PRO-ENVIRONMENT VOTE. On May 22, the Senate approved H.J.Res. 89.
