Representative Troy Downing (R-MT) introduced H.J. Res. 104, a Congressional Review Act (CRA) resolution of disapproval, which would reverse the Bureau of Land Management Miles City Resource Management Plan (RMP). The CRA is an extreme and blunt tool that is being used by anti-environmental members of Congress who want to permanently strip away protections for our environment, communities, wildlife, and natural heritage. Using the CRA on an agency RMP is unprecedented and inconsistent with the practices of developing and revising management plans across both Republican and Democratic administrations. Not only would this resolution of disapproval open up almost 3 million acres of public lands to more extraction, it also could set a dangerous precedent that could prevent federal land management agencies from adopting any land use plans for any activities included in previous plans – throwing our land management system into chaos by hamstring agency ability to issue management guidance. On September 3, the House approved H.J. Res. 104 by a vote of 211-208 (House roll call vote 224). NO IS THE PRO-ENVIRONMENT VOTE. On October 8, the Senate approved H.J.Res. 104 by a vote of 52-47 (Senate roll call vote 549).
