Representative Andy Biggs (R-AZ) sponsored H.R. 77, the so-called Midnight Rules Relief Act, which would amend the Congressional Review Act (CRA) to allow dozens of regulations finalized near the end of a presidential term to be disapproved using a single joint resolution. The CRA is an extreme and blunt tool that is being used by anti-environmental members of Congress who want to permanently strip away protections for our environment, communities, wildlife, and natural heritage. H.R. 77 would make it easier for narrow majorities of lawmakers to repeal large numbers of safeguards that have each gone through extensive legal and scientific review and public comment. These repeals have long-lasting impacts because, under the CRA, future administrations cannot issue new rules that are substantially the same, which significantly constrains agencies’ authority to carry out their statutory missions to protect our environment and our health. On February 12, the House approved H.R. 77 by a vote of 212-208 (House roll call vote 41). NO IS THE PRO-ENVIRONMENT VOTE. The Senate took no action on this legislation in 2025.
