Senator Mark Kelly (D-AZ) sponsored S. 2228, the Building Chips in America Act, which would eliminate environmental review and public input under the National Environmental Policy Act (NEPA) for certain semiconductor manufacturing facilities. The bill is unnecessary. Federal permitting is not delaying chips manufacturing projects, and following the bill’s introduction, the Biden-Harris administration adopted the categorical exclusions that the bill would have established. On September 23, the House approved S. 2228 by a vote of 257-125 (A 2/3rds majority was needed for passage; House roll call vote 440). NO IS THE PRO-ENVIRONMENT VOTE. On October 2, the president signed it into law.
